LEGISLATION OPENS BIRTH AND ADOPTION RECORDS IN MANITOBA


Effective June 15, 2015 changes to The Adoption Act and The Vital Statistics Act will allow for more openness with respect to birth records related to adoption. Read the news release here: https://news.gov.mb.ca/news/index.html?item=30552.

  1. What is changing?

  2. Manitoba's new legislation will allow adoptees and birth parents to access available identifying information. It will also allow them to keep their information confidential if they wish.

  3. How do these changes impact registration of Manitoba births after an adoption has taken place?

  4. If you or your child is an adoptee that was born in Manitoba and adopted after June 15, 2015, you can now apply to the Vital Statistics Branch for a Substituted Registration of Birth on Adoption for the adoptee.

    The Substituted Registration of Birth on Adoption allows more transparency with respect to birth registrations related to adoption, and will identify an adoption occurred, the child's post-adoption name, and information about the adoptive parents.

    The Substituted Registration of Birth on Adoption is a necessary step to obtain a birth certificate for the adoptee.


  5. How do I apply for a Substituted Registration of Birth on Adoption?

  6. Substitution of Registration of Birth on Adoption:

    If you or your child is an adoptee that was born in Manitoba and adopted after June 15, 2015, you can now apply to the Vital Statistics Branch for a Substituted Registration of Birth on Adoption for the adoptee by completing the application form.

    The fee for a Substituted Registration of Birth on Adoption is $30.00.

    Birth Certificate:

    If you want a birth certificate showing post-adoption information, complete a separate Application for a Manitoba Birth Document and submit with your Application for a Substituted Registration of Birth on Adoption.

    The fee for a birth certificate is $30.


    The total cost for a Substituted Registration of Birth on Adoption and Certificate of Birth is $60.00.


  7. What if the adoption occurred in Manitoba but the adoptee was born elsewhere?

  8. If you or your child was adopted in Manitoba, but born elsewhere, contact the jurisdiction of the child's birth to determine whether the original birth registration can be substituted to reflect an adoption that occurred in Manitoba.
